Ticketing on this site is operated by Ferve Tickets (“we”, “us”, “our”) on behalf of a client (“the organiser”). You should also be aware of the appropriate policies of the organiser, as any contract entered into for the sale of tickets exists between you and the organiser.

Refunds

Ferve Tickets cannot issue refunds directly, you must contact the event organiser for a refund.  You agree as part of the purchase of tickets on our system to the refund policies of the event organiser, which are made available during the checkout process, and on their website.

Security
We take all reasonable steps to preserve the security of your temporary and personal information whilst in transit or stored in our systems.
2048 bit or higher SSL encryption is used to secure all personal information while in transit on the internet.

Your account security
While we force a complex account password, you are ultimately responsible for the security of your account.
You should not disclose your account details to any person, and change your password from time to time as appropriate.

If you buy tickets or products from this website, we will not record your full credit card details at any time, but pass your information into the Banking Network for authorisation.
Our site also may contain the ability to store a reference to your first card authorisation to facilitate the 2nd or subsequent credit card purchases from our site.
In cases where you agree to use this facility, we are not storing full card details, but a reference to the original transaction. This allows us to offer a faster checkout process for customers. We will not use this facility without your permission. Where you wish to clear all references to previously authorised transactions you may do so from your account at our website. Should you do this, all stored references to cards are deleted, and you must again enter full card details to purchase through us.

While we take all reasonable precautions for security of your information, the transfer of your private information to this site is ultimately at your own risk.

We respect your rights to privacy under the appropriate Australian legislation (Privacy Act 1988 (Commonwealth)) and other legislation as appropriate.
We will not release your private information to any party (except the organiser), or as required to by law.  You should also check with the organiser as they may have separate privacy and other terms that you agree to by using this site.

General Information collected

In an unsecure area of the website (where you have not logged in), we will record the date/time of your visit, your IP address, type of web browser, and the pages/information visited, but no personally identifiable information (such as your name, email address or address).  This may include setting cookies and other locally stored data that is important for you to be able to use the site correctly.

Some information may be transmitted to other third parties such as Facebook and Google, however this should not include any personally identifiable information.  This information is used for the purposes of evaluating and improving user interfaces, page and website speed, and conversion to purchase paths.

If you log in to our systems, either by the standard account login, or a third party social media plug in, we will record personal information (name, email address, address, contact phone number) in order to facilitate your use of this site, such as delivering tickets or allowing access to newsletters.
If you use the social media functions of this website, we may record additional information from your social media profile (profile name, type of social media) in order to facilitate your use of this site. We will not post information to your social media profile unless you specifically take action to share content to your profile.

Should you wish to use the system you must accept cookies in your web browser.  The cookies contain information about your use of the system, and allow your requests to be authenticated and secured.  No private information is stored in cookies.  Typically cookies are valid for the length of your session only.  Some cookies may optionally be stored by third parties for example Facebook or Google during your use of the system, but only for the purposes of captcha, or generalised analytics conversion tracking.

Personal Information collected

When you purchase tickets we may require additional information including your name, address, email address and contact phone number. This information is collected only to allow the delivery of tickets, and to be able to keep you informed about the events that you have purchased. We do not engage in direct marketing to end user customers, but organisers you purchase from via us may do so depending on their policies. Where you purchase tickets from an organiser you agree to receive email, SMS and voice communications relating to every purchase which may include receipts, tickets, and notices relating to the items purchased (such as a postponement or cancellation).  Even if you have unsubscribed from marketing lists maintained by the organiser, if you purchase from this site you will still be contacted for the purposes of delivering the items you buy. Purchasing items constitutes your agreement to this policy.

Requests to remove personal information

If you wish to remove your personal information, this request should be put in writing to the organiser that you purchased tickets from.  We will facilitate any requests forwarded from organisers.  If you do not receive a response from the organiser within a reasonable time frame, please contact our privacy officer below indicating the organiser you purchased from, your email address used to purchase, and the information you would like removed.  We cannot remove records of your purchased items, but can permanently anonymise your account details so that no personally identifiable information remains.

Legal basis for collection of data

If you place an order with us, we will require certain information in order to fulfil the contract created by your purchase with the organiser. This may include collecting your name, address, email address and a contact phone number. We may also require, but not store, your payment information. It is essential that you provide your email address and a contact phone number so that we can send you confirmation of receipt of your order, notify you of any changes to events, and contact you.

Article 6 (1) b of the GDPR is the legal basis for data processing for the purpose of performing a contract or for carrying out precontractual activities as a result of an enquiry.

When processing your order, we will pass on personal data to service partners such as payment service providers (including, banks, Paypal, Stripe, and credit card companies) as this is necessary for the performance of your contract with us. Your personal data will also be passed on to the organiser of the events you have purchased for the purpose of supplying events or goods to you. The organiser must use the transferred data only for the performance of its task(s) (delivery of events or goods). Any use beyond that is not permitted unless they inform you otherwise.

Personal data processed for the performance of the contract will be stored by us for the statutory period of limitation.

Financial data necessary under commercial or fiscal law will be stored by us for the retention periods typically needed under European law, generally for a period of 10 years.

Cookies

Cookies are text files stored on your browser which contain certain settings and data. We use cookies on our website to provide you with an optimal user experience, and help ensure the security of your account and other session information.  Should you wish to use the system you must accept cookies in your web browser.  The cookies contain information about your use of the system, and allow your requests to be authenticated and secured.  No private information is stored in cookies.  Typically cookies are valid for the length of your session only, however a visitor cookie may persist for up to 30 days to allow us to evaluate multiple purchase patterns and visits to the ticketing site over time.  Some cookies may optionally be stored by third parties for example Facebook or Google during your use of the system, but only for the purposes of captcha (security), or generalised analytics conversion tracking.  You should also check with the organiser for GDPR disclosures as they may also add other cookies or settings used for other purposes such as re-marketing or advertising – Ferve Tickets itself does not carry out re-marketing or advertising services.

Article 6 (1) f of GDPR is the legal basis for the use of cookies. The essential justified interest lies in maintaining the functionality and security of the ticketing system.

Log files

When you visit our website, your browser will send request data to our servers. We will store the data and time, the IP address being used to request the information, the type of request (GET,POST, HEAD etc), the response status, the bytes transferred, the name of the file or end point accessed,  the referrer URL (the previous page you accessed prior to this action), information on the Internet browser used (Type, Version), as well as the Operating system and version.

This information is maintained for at least 12 months to comply with our PCI-DSS security obligations, and to ensure our site remains secure and functional.

Article 6 (1) f of GDPR is the legal basis for this data processing – the essential justified interest is in maintaining the functionality and security of the ticketing system. 

Transfer of data

Under Article 49 (1) c of GDPR you are hereby notified that private data may be transferred to Australia, on the basis that the transfer is necessary for the conclusion or performance of a contract concluded in the interest of the data subject between the controller and the organiser you are purchasing tickets from.
 

Your rights as a user

We have briefly summarised your rights under GDPR below.  You may have additional rights under the GDPR, which you should exercise as you need to.  The full GDPR can be found at https://gdpr.eu.

Right to revoke your declaration of consent under data protection law (Article 7 (3) GDPR)

You have the right time to revoke your consent at any time. Revocation of your consent will not affect the legality of processing carried out on the basis of your consent up to the time consent is withdrawn.

Right of access (Article 15 GDPR)

Under Article 15 GDPR, you have the right to demand from us confirmation of whether we process personal data concerning you. If this is the case, you have the right to access this personal data and the information we hold about you.

Right to rectification (Article 16 GDPR)

You may demand that we rectify inaccurate data concerning you. You may demand that we complete or update personal information about you where it is found to be inaccurate.

Right to erasure or “right to be forgotten” (Article 17 GDPR)

You have the right that we erase your personal data if the data is no longer needed, if you revoke consent, if you lodge an objection to processing under Article 21 (1) or (2), if the data has been unlawfully processed, or erasure is required to fulfil a legal obligation under European law.

If we are obliged to erase your data, we will anonymise and permanently destroy all personally identifiable information such as your name, address, phone number, email address and any partial remaining credit card data.  A record of your purchases for example, events and merchandise, will be maintained for financial reporting and tax purposes as required by law.

Right to restriction of processing (Article 18 GDPR)

According to Article 18 GDPR, we must restrict processing of your data if you dispute its accuracy, if the processing is unlawful, if we no longer need the data – but you need the data for asserting or defending legal claims, or if you lodge an objection to processing under Article 21 (1) of GDPR.

If processing is restricted, we shall still be permitted to store this data. Any further processing of data will then require your consent.

You may revoke your consent given under this article at any time.

Notification obligation (Article 19 GDPR)

All recipients to whom your data has been disclosed must be informed by us of any rectification or erasure of your data, or of any restriction of processing. This will be inapplicable only insofar as this proves to be impossible or is associated with disproportionate expense. We shall inform you of these recipients if you so request.

Right to data portability (Article 20 GDPR)

You have the right to receive the data concerning you that has been provided to us. Additionally, you have the right that we transfer this data to a third party as required.

Automated decision-making in individual cases, including profiling (Article 22 GDPR)

You have the right not to be subject to a decision based solely on automated processing that has legal effect or impairs you in a similar manner. Ferve Tickets itself does not automate decision making in individual cases, however you should check with the organiser for disclosure of any automated decision making processes.

Right to object (Article 21 GDPR)

You have the right to object to data processing under Article 6 (1) f of GDPR if there are grounds for this based on your particular situation. Following your objection, your data will no longer be processed for these purposes.

Right to lodge a complaint with a supervisory authority (Article 77 GDPR)

You have the right to lodge a complaint with a supervisory authority if you believe the processing of the data concerning you breaches GDPR.
